GTS – General Terms of Sale

These General Terms of Sale (hereafter, “GTS”) manage the contractual relationship between, on one hand the company Hauska Poro, registered in the commercial register of the country of Finland at number 3164960-3 with their head office at 90500, Kalliotie 12 A 30, Oulu, Finland, and on the other hand, any physical or legal person wishing to make a purchase on the website Cosynesty.com, hereafter “the Buyer”.

We welcome you to read those GTS carefully before placing an order on website Cosynesty.com. Any order placed on this website implies your express and unreserved acceptance of these GTS. Their formal acceptance will be asked of you before validating your order.

Hauska Poro reserves the right to modify these GTS as well as the pricing conditions of its products and its subscriptions. The new GTS will be, if need be, brought to attention to the customer by an online modification, and can only be applied to sales made after the modifications. The currently applicable GTS may be viewed at any moment on the Website and can be printed from there.

Definitions

“Catalog”: refers to all the Items and Products for which are made available to the Member in the boutique: Cosynesty.com.

“Member” or “subscriber”: refers to any natural person who approves these General Terms and Conditions of Sale, and who thereby accesses Cosynesty.com and subscribes to the Service by creating an account as specified below.

“Territory”: means the following countries of the European Union: Germany, Austria, Belgium, Spain, Estonia, Finland, Metropolitan France, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Portugal, Slovakia and Slovenia.

Products

The products offered are those available on the website Cosynesty.com of company Hauska Poro, as long as stocks last. The company Hauska Poro reserves the right to modify the selection of available products and their prices at any time. Each product is presented on the Internet website under a description summing up its main technical characteristics. The photographs are as faithful as possible, but do not bind the Seller. The sale of products presented on website Cosynesty.com is destined to any buyer residing in countries fully authorizing the entry of said products on their territory.

Tariffs

The prices shown on the product sheets of the Internet catalog are prices in Euros (€), or converted into the currency of the user’s choice, including taxes (VAT), reflecting applicable VAT at the time of order. Any modification on the VAT can be reflected on the price of the products. The company Hauska Poro reserves the right to modify its prices at any time, as long as the price shown on the catalog the day of the order is the only one that is applicable to the Buyer. The stated prices do not include delivery fees, billed in addition to the bought product prices according to the total amount of the order.

Order and payment options

Before ordering, the Buyer must create an account on website Cosynesty.com. The account creation menu is accessible directly on the menu bar. On each visit, the Buyer, if they decide to order something or check out their account (order status, profile…), must log in with these identifiers. The company Hauska Poro offers to the Buyer the possibility of ordering and paying for their products in multiple steps, with the secured bank card payment method: the Buyer selects the products they want to order in the “cart”, makes changes if they want (amounts, references…), checks the delivery address or adds a new one. Then, the delivery fees are calculated and shown to the Buyer, as well as the delivery company’s name. The next step lets them go over all the information, as well as read and accept these General Terms of Sale by checking the corresponding box, and then lets them validate their order by clicking on the “Confirm my Order” button. Finally, the Buyer is redirected to the secured interface letting him securely fill in his bank card details. If the payment is accepted, the order is registered and the contract definitively formed. A bank card payment is irrevocable. In case of fraudulent use, the Buyer may demand that the bank card payment is cancelled, in which case the paid sums will be refunded or reimbursed. The owner of a bank card may not be held responsible if the disputed payment has been proved to be fraudulent, remote, and without physical use of their bank card. To get refunded from the fraudulent transaction and any bank fees that the operation may have incurred, the card’s holder must dispute, in written form, the transaction at his bank, in the 70 days following the operation, or 120 days if the contract binding them to that operation allows it. The amounts withdrawn will be refunded by the bank in a maximum timespan of a month after receiving the written dispute sent by the holder. No fees for restituting the sums can be incurred to the holder.

Confirming an order implies acceptance of these General Terms of Sale, their acknowledgment and a waiver of one’s own terms of sale. All the given data, as well as the registered confirmation, will serve as evidence of the transaction. If the Buyer has an e-mail address and they filled it out on their order, the company Hauska Poro will send them by e-mail a digital confirmation of the registration of their order.

Subscription

Cosynesty.com offers a non-binding subscription service that gives to their users access to additional services that are otherwise unavailable (or requiring additional costs) for regular customers. These services include priority delivery and exclusive discounts on the Catalog.

If you are a new customer, you may get a trial offer with automatic renewal that can be cancelled at any time.

You may cancel your paid subscription to Cosynesty.com, or prevent your trial period being converted into a paid subscription at any time from your Cosynesty.com account or at the following address: https://www.cosynesty.com/subscription-management/

However, beware: Any cancellation of the service immediately interrupts your access to the privileges of subscribed members of Cosynesty.com.

If your trial period ended without you noticing, the amount of your registration may be fully refunded by a simple request to customer service (by e-mail at support@cosynesty.com or by phone at +44 1854 330857, price of a local call). It is possible to do so only if you never used the services linked to the subscription, whether it’s a priority order, an exclusive discount, or anything else.

Conversely, if you have already used your subscription during the trial period, whether it is a priority order or the use of any of the different services, Cosynesty.com is not forced to refund your subscription fees.

Reservation of ownership

The company Hauska Poro keeps the full and entire property of the sold products until full collection of the price in whole, fees and taxes included.

Withdrawal

The Buyer has a delay of fourteen work days from delivery of their order to use their right to withdrawal, and send back the product to the seller for exchange or refund without any penalty, excluding return shipping fees.

Delivery

The deliveries are made to the address written on the purchase order, which may only be located in the agreed-upon geographical zone. The delivery periods are only indicative; if those are higher than thirty days from the order, the sale contract may be revoked and the Buyer refunded. The company Hauska Poro may send to the Buyer, via e-mail, the tracking number of their package. The Buyer gets his order delivered to their home by their postman. If the Buyer is away, they will receive a notice from their postman, letting them retrieve the ordered products at the nearest post office or pick-up spot, during a period highlighted by the delivery services. The risks tied to delivery are the burden of the purchaser from the moment the items leave the facilities of company Hauska Poro. The Buyer shall check, in the presence of the delivery man, the state of the packaging and the content of their order when the delivery is made. In case of damage during transportation, any complaint must be brought to the delivery company in a period of three days after the delivery.

Warrancy

All of the products offered by company Hauska Poro are under warrancy. If a sold product is non-compliant, it can be returned to company Hauska Poro, which will take it back, exchange it or refund it. Any dispute, exchange or refund requests must be done by written mail to the following address: Hauska Poro, 90500, Kalliotie 12 A 30, Oulu, Finland, in a period of thirty days after delivery.

Responsibility

The company Hauska Poro, in the process of online sales, is only held to an obligation of means. They may not be held responsible for damage resulting from using the Internet network, such as data loss, intrusion, virus, service failure or other involuntary issues.

Managing disputes

These online terms of sale are subject to the laws of the country of Finland. For any dispute or conflicts, the competent courts will be those of Finland.
